JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner seeks regular bail in connection with Aurai P.S. Case No.99 of 2015 registered for the alleged offences under Section 387 of the Indian Penal Code.

As per the prosecution case, some unknown miscreants claiming themselves to be members of MCC demanded as extortion Rs.50,000.00 from the informant on two occasions by two mobile phones.

It has been submitted by learned counsel for the petitioner that petitioner is not named in the F.I.R. Nothing incriminating article has been recovered from the conscious physical possession of the petitioner. He has not demanded any extortion money. None of the mobile phone as mentioned in the

Patna High Court Cr.Misc. No.32525 of 2017 (02) dt.13-07-2017 2/2 F.I.R. is hailing to him. He has been remanded in this case from some other case on the basis of confessional statement. Barring said confessional statement, there is nothing against the petitioner to indicate his complicity in the occurrence. The allegations levelled against the petitioner is not specific rather general and omnibus in nature. He has been languishing in jail custody since 22.09.2015.

In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned J.M. 1st Class, Muzaffarpur in connection with Aurai P.S. Case No.99 of 2015.
