JUSTICE ARUN KUMAR ORAL ORDER 13-06-2017 Heard learned counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Pranpur (Roshna) P.S. Case No.40 of 2017 registered under Section 30(a) of Bihar Prohibition and Excise Act.

Allegation in brief is that the petitioner was carrying a bag along with foreign liquor in total containing 13 1⁄2 liters illegal liquor.

Learned counsel for the petitioner submits that the petitioner is a labourer. He has clean antecedent and has been in custody since 19.3.2017.

Having considered the said facts and circumstances, the petitioner, namely, Milan Kumar Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten

Patna High Court Cr.Misc. No.22838 of 2017 (2) dt.13-06-2017 2/2 thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-Cum-Special Judge (Excise Act), Katihar in connection with Pranpur (Roshna) P.S. Case No.40 of 2017.
