JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 04-04-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Shahkund P.S. Case No. 108 of 2017 registered under Section 395 of the Indian Penal Code.

Several unknown miscreants are said to have looted belongings of the barat party.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in this case. He is neither named in the F.I.R. nor any incriminating article has been recovered from his conscious physical possession. Though he has been identified by one of the victim Mithilesh Jha, but it is a case of single T.I.P.

Patna High Court Cr.Misc. No.13361 of 2018 (4) dt.04-04-2018 2/2 Similarly situated co-accused, namely, Ashok Das, Chamaklal Singh and Ramji Prasad Yadav have been enlarged on bail by different co-ordinate benches of this court. The petitioner has no criminal antecedent. He has been languishing in custody since 12.06.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bhagalpur in connection with Shahkund P.S. Case No. 108 of 2017.
