JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bhagwanpur P.S. Case No. 34 of 2012 registered for the offences punishable under Sections 147, 148, 149, 435, 436, 427 of the Indian Penal Code and Section 3 (i) (x) of S.C./S.T. (Prevention of Atrocities) Act.

Taking into consideration that there is specific allegation of setting the informant's house on fire against the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Bhagwanpur P.S. Case No. 34 of 2012 pending in the court of learned Judicial Magistrate 1st Class,

Patna High Court Cr.Misc. No.7536 of 2015 (2) dt.26-02-2015 Begusarai stands rejected.

However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
