JUSTICE ARUN KUMAR ORAL ORDER 13-06-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State.
Petitioner, already in custody, seeks bail in connection with Barachatti P.S. Case No.186 of 2016, registered under Sections 364, 323 and 307/34 of the Indian Penal Code, Section 27 of the Arms Act as well as Section 17 of the C.L.A. Act.
Allegation in brief is that three accused persons including the petitioner kidnapped the informant on motorcycle and moved from one village to another. Some other accused also joined them and they had brought the informant to his house. Thereafter they brought the informant to some other place where police reached and the accused persons fired on the police personnel also, left him there and escaped.
Learned counsel for the petitioner submits that except he statement of the informant, there is no other evidence. According to the
Patna High Court Cr.Misc. No.23825 of 2017 (3) dt.13-06-2017 2 / 2 informant himself he was left by the accused persons on the same day and the case is lodged on the next day and one Santosh Yadav has been granted bail by a coordinate Bench of this Court vide order dated 2012.2016, passed in Cr. Misc. No.53014 of 2016 and this petitioner has been in custody since 30.09.2016.
The learned APP appearing on behalf of the State opposes the prayer of bail by submitting that the petitioner has criminal antecedents.
Having considered the said facts and circumstances, petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati (Gaya) in connection with Barachatti P.S. Case No.186 of 2016 with the condition that one of the bailors must be a family member of the petitioner and the petitioner shall be present before the trial court on each and every date and in case of absence on two consecutive dates, the bail bond of the petitioner shall be liable to be cancelled.
