The petitioner apprehends her arrest in Sahebganj P.S. Case No. 93 of 2011, registered for the offences punishable under Section 304(B) and other Sections of the Indian Penal Code. The informant made allegation that his niece Sangita Devi was killed by her husband and other in-laws. Learned counsel for the petitioner submits that police after investigation submitted final form against the petitioner and the case was found true only against the husband that too only under Section 306 of the Indian Penal Code. The petitioner is mother-in-law of the deceased.

Considering the facts aforesaid and the fact that the accusations against the petitioner was not found true, the

Patna High Court Cr.Misc. No.6755 of 2015 (2) dt.19-02-2015 2/2 petitioner, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Rashmi, the learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Sahebganj P.S. Case No. 93 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
