The petitioners seek bail in a case instituted for the offences under Sections 395 and 397 of the Indian Penal Code.
Earlier this Court vide order dated 19.2.2016 passed in Cr. Misc. No.57124 of 2015 rejected the prayer for bail of the petitioner with a liberty to renew their prayer for bail after completion of one year in jail custody.
One year has already expired for rejection of the order. Having considered the facts and circumstances of the case, let petitioners, namely, Rajendra Manjhi and Dharma Manjhi alias Dharm Manjhi, be released on bail on furnishing
Patna High Court Cr.Misc. No.20572 of 2017 (3) dt.21-06-2017 bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the 3rd Additional District & Sessions Judge, Muzaffarpur in connection with Saraiya P.S. Case No.283 of 2015 corresponding to S.T. No.227 of 2016, subject to the conditions that (i) one of the bailors shall be a close relative of the petitioners i.e. father, mother, wife or son (ii) If the petitioners are found involved in future in similar type of case the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order including cancellation of bail (iii) Petitioners shall mark his presence before the nearest police station by 7th of every month till six months and (iv) petitioners would participate in the court proceeding and in the event of being absent on two consecutive dates without any reason, the court below will be at liberty to cancel the bail bonds of the petitioners.
