The petitioner, who is in custody, seeks bail in connection with Paraiya P.S. Case No. 02 of 2006 registered for the offence punishable under Sections 147, 148, 149, 341, 342, 436, 427 and 353 of the Indian Penal Code and Section 17 of the Criminal Law Amendment Act.

Complainant is Junior Engineer of a Company who has stated that on 02.01.2006 at about 9:00 PM about 100 unidentified miscreants came and burnt the tent of the labourers by sprinkling petrol over it and also assaulted employees who were there and all articles kept in tent was burnt to ashes and while going away they also threatened that if levy

Patna High Court Cr.Misc. No.4349 of 2018(2) dt.09-02-2018 2/2 is not paid to them they will kill him. Name of the petitioner has transpired on the basis of information given by Spy and except said information there is nothing against the petitioner. It has been submitted that petitioner is in custody since 31.10.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Paraiya P.S. Case No. 02 of 2006.
