JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-07-2019 Learned counsel for the petitioner submits that the petitioner has been compelled to move this Court when the Supply Appeal Case No. 84/2011-12 preferred before the Collector, Banka on 20.10.2011 has not been disposed off till date.

Learned counsel for the State submits that in the given facts and circumstances of the case, the Collector, Banka be directed to consider and dispose off the pending appeal, if any, within a reasonable time.

In the facts of the present case, this Court finds that supply appeal in this case was preferred on 20.10.2011 meaning thereby seven years have gone past. If the appeal has not been considered and disposed off till date, it is an alarming situation

Patna High Court CWJC No.4224 of 2019(2) dt.11-07-2019 2/2 and invites the attention of this Court calling upon its concerns to direct the Collector, Banka to hear and dispose of this appeal within 30 days from the date of receipt/production of a copy of this order, failing which the State will be liable to pay a sum of Rs. 25,000/- as cost for keeping the appeal pending itself for seven years which has definitely caused harassment to the petitioner in pursuing the matter in all these years and compelling him to move this Court in its writ jurisdiction. Let the appeal be heard and disposed off on merit with a reasoned order within 30 days from the date of receipt/production of a copy of this order and the same may be communicated to the petitioner within next 15 days, failing which the consequences shall follow.
