Petitioner seeks regular bail in connection with Forbesganj P.S. Case No.113 of 2017 registered for the alleged offences under Section 379 of the Indian Penal Code but later on Section 411 of the Indian Penal Code also added. As per the prosecution case, the motorcycle of the informant was lifted by some unknown miscreants. It has been submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He is not named in the F.I.R. His name has surfaced in this case in the confessional statement of one co-accused Sanjay Paswan. Barring it, there is nothing on record indicating the complicity of the petitioner in the

Patna High Court Cr.Misc. No.30893 of 2017 (02) dt.06-07-2017 2/2 occurrence. He has been languishing in jail custody since 23.04.2017.

In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No.113 of 2017.
