Petitioners, already in custody, seek bail in connection with Sour Bazar P.S. Case No.46 of 2017, registered under Section 366 of the Indian Penal Code.

Allegation in brief is that these two petitioners kidnapped the married daughter of the informant.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case and in the statement the girl has specifically made allegation against one Lalwa.

Learned counsel for the State submits that the victim girl in her statement stated that she was kidnapped by the petitioners

Patna High Court Cr.Misc. No.8913 of 2018(2) dt.15-02-2018 2/2 and one Lalwa and she was kept in confinement for three months and they also used to rape her.

Having considered the specific allegation against the petitioners, the prayer of bail of the petitioners is rejected in connection with Sour Bazar P.S. Case No.46 of 2017, pending in the court of learned C.J.M., Saharsa.

However, the trial court is directed to expedite the trial and preferably conclude the same within two years. (Arun Kumar, J) S.KUMAR/- U T
