ANJANA MISHRA ORAL ORDER 08-03-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 21.10.2017 in connection with Motipur P.S. Case No.389 of 2017 registered for the offence under Sections 25(1-b)a and 26 of the Arms Act. Learned counsel for the petitioner submits that the alleged recovery was not made from the conscious possession of the petitioner and he is already in jail custody for about five months. He further submits that after being taking into custody in connection with the present case, he was also remanded in Sahebganj P.S. Case No.243 of 2017 on the basis of the confessional statement made by co-accused.

Having considered such facts and circumstances of

Patna High Court Cr.Misc. No.11693 of 2018 (2) dt.08-03-2018 2/2 the case and also the period of custody, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate (West), Muzaffarpur, in connection with Motipur P.S. Case No.389 of 2017.
