JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-07-2015 This is one of the unfortunate cases where an FIR has been instituted by the Informant against his full brothers. This is an application seeking anticipatory bail by the petitioners who are full brothers of the informant. It is alleged that the petitioners assaulted the informant causing injuries and took away certain valuable, thus, constituting offences under Sections 447,341,323,325,379 and 504/34 of the Indian Penal Code.
I have heard learned counsel for the petitioners, learned counsel appearing on behalf of the Informant as well as learned Additional Public Prosecutor appearing on behalf of the State. Learned counsel for the petitioners has submitted that
Patna High Court Cr.Misc. No.7540 of 2015 (4) dt.02-07-2015 property dispute between the parties is the reason behind institution of the present case containing false allegation. Learned counsel for the informant has opposed the prayer for bail and has submitted that the petitioners should take steps to restore peace in the family.
In view of the submission as above, let above named petitioners in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in Kurhani P.S. Case No. 417 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
