2. The petitioner apprehends his arrest in connection with Adapur P.S. Case No. 179 of 2023 dated 12.06.2023, registered for the offences punishable under Sections 498A and 302 of the Indian Penal Code.

3. As per the prosecution case the marriage of the informant's mother was solemnized with accused-petitioner, namely, Pappu Singh about 19 years ago. The allegation against the accused persons including petitioner is of committing cruelty, torture and assaulting the informant's mother. It is further alleged that the alleged victim has been burnt to death in the matrimonial home and the case has been registered by the daughter of the deceased against her father, grand father and fua

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that nobody has burnt her. In fact, she has died on account of accidental fire arising out of bursting of gas stove.

5. It has also been stated in paragraph no.3 of the bail petition that the petitioner has no criminal antecedents.

6. It is also stated in paragraph no. 2 of the petition that petitioner has never moved before this Hon'ble Court for grant of Anticipatory Bail or Regular Bail.

7. However, Ld. APP for the State vehemently opposes the prayer of the petitioner for anticipatory bail submitting that similar application of co-accused persons, namely, Raj Narayan Singh and Neelu Singh @ Leela Devi @ Keeka Devi has already been rejected by this Court vide order dated 20.05.2024 passed in Cr. Misc. No. 27044 of 2024.

8. Considering the nature of the allegation and the fact that the victim has died on account of burning in her matrimonial home, this Court is not persuaded to enlarge the petitioner on anticipatory bail.
