The petitioner seeks bail in Tarabari P.S. Case No. 110/2018, instituted for offences under Section(s) 302 and 201 and 34 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that petitioner is own brother of informant. He is named in the Fardbeyan only due to land dispute but later on compromise petition has been filed by the informant before the court below, copy of which is annexed as Annexure-3.
It is alleged in the written report that wife of informant went missing. Later on her dead body was recovered from near Chachari Bridge in Kuriya Dhar.
Informant has also raised suspicion against other two
Patna High Court CR. MISC. No.14179 of 2019(2) dt.07-03-2019 2/2 brothers in committing murder of his wife.
In this manner, mere suspicion has been raised against this petitioner.
Petitioner is in custody since 05.12.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with Tarabari P.S. Case No. 110/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
