The petitioner seeks bail in Bihta P.S. Case No. 714 of 2017 registered for the offence punishable under Sections 25(1B)A, 26 and 35 of the Arms Act. Allegation against the petitioner is of recovery of pistol from his possession.

It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case due to village politics. It has been further submitted that similarly situated co-accused person had been granted bail by a coordinate bench of this Court vide order dated 01.02.2018 in Criminal Miscellaneous No. 4651 of 2018. Petitioner has got no criminal antecedent and is in custody since 18.09.2017.

No.2266 of 2018(3) dt.07-02-2018 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Danapur, Patna in connection with Bihta Town P.S. Case No. 714 of 2017.
