JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 504 and 506/34 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.
The accusation is of making assault and abusing the informant by calling caste name.
It is submitted by learned counsel for the petitioners that for petty dispute, the accusation has been levelled and subsequently the informant has retracted from his initial version and filed a petition to that effect before the learned court below. A statement has been made in para 3 of the petition that the
Patna High Court Cr.Misc. No.6831 of 2015 (2) dt.20-02-2015 2/2 petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., Raxaul at Motihari in connection with Motihari (SC/ST) P.S. Case No. 71 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
