The petitioner seeks bail in connection with Gopalpur P.S.Case No. 113 of 2010 registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. It is submitted by the learned counsel for the petitioner that though the petitioner has remained in custody for over four years, the trial has not concluded. It is also submitted that several other co-accused having identical allegations to that of the petitioner have already been granted bail by different orders passed by different Benches of this Court.

Be that as it may, regard being had to the reasons assigned in my earlier order dated 09.12.2015 passed in Cr.Misc.

Patna High Court Cr.Misc. No.27267 of 2017 (2) dt.21-06-2017 2/2 No. 55592 of 2015, I am not inclined to grant bail to the petitioner for the present. Accordingly, the prayer for bail is rejected. Learned 2nd Additional Sessions Judge, Naugachia, Bhagalpur is directed to hold trial expeditiously and conclude the same within nine months from the date of receipt of this order. In case the trial is not concluded within the period stipulated hereinabove, the trial court shall assign reasons as to why trial could not be concluded within the time granted by this Court in its order if the petitioner chooses to renew his prayer for bail.
