JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-02-2020 The petitioner, who is in custody since 13.11.2019, seeks bail in connection with Bathnaha P.S. Case No. 224 of 2019, dated 02.11.2019, instituted for the offences under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is alleged to have fired from his weapon leading to death of the deceased.

There does not appear to be any mitigating

Patna High Court CR. MISC. No.11083 of 2020(2) dt.28-02-2020 2/2 circumstance which could be read in favour of the petitioner. Considering the direct allegation against the petitioner, I am not inclined to grant bail to him for the present.

The prayer for bail is, accordingly, rejected. The application stands dismissed.
