2. The petitioners seek bail in a case registered for offence under Sections 303(2), 317(2), 317(4), 318(4), 61(2), 111, 3(5) of the B.N.S., 2023.

3. As per F.I.R., petitioner no. 1 was driver and petitioner no. 2 was cleaner/Khalasi of one of the Hyva Trucks, which was involved in illegal mining and transportation of sand. Petitioners are also alleged to have misused the challan and used the same for several times for transportation of sand.

4. Learned counsel for the petitioners submits that petitioners are quite innocent and have committed no offence.

No.12416 of 2025(4) dt.08-08-2025 2/2 He further submits that similarly situated co-accused Ranjay Kumar has already been granted bail by a coordinate Bench of this Court, vide order dated 09.05.2025 passed in Cr.Misc. No. 11362 of 2025. Petitioners have got clean antecedent and are in custody since 26.12.2024. Chargesheet has been submitted.

5. Learned A.P.P. for the State vehemently opposed the bail petition.

6. Considering the period of custody and clean antecedent, let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Nawada in connection with Roh P.S. Case No. 418 of 2024.
