The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 273 of the Indian Penal Code and 47(a) of the Excise Act. 45 litres of spirit were recovered from the embankment of the river when the petitioner was found fleeing away from the place of seizure.

It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled and the recovery cannot be treated from the possession of the petitioner.

A statement has been made in paragraph 3

Patna High Court Cr.Misc. No.10543 of 2016 (2) dt.08-03-2016 2/2 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Gaya in connection with Tekari P.S. Case No. 31 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
