2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) 41(1) of Bihar Prohibition and Excise (Amendment) Act.
3. It is alleged that 11600.00 litres intoxicated material Ethyl Alcohol from the truck was recovered from the truck .
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case. Petitioner is neither owner nor driver of the vehicle in question . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid

5. Learned counsel for the State opposes the bail petition.
6. Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Exclusive Excise Judge , Sasaram at Chapra in connection with Sonepur Police Station Case No. 1118 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
