The petitioner apprehends his arrest in Kotwali P.S. Case No. 352 of 2014, registered for the offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act. The police got information that one vehicle met with an accident. The police went there and apprehended one person namely Mithilesh Kumar from the car. One loaded country made pistol was recovered. Name of the petitioner figured in the case in the disclosure of Mithilesh Kumar.
Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot nor anything was recovered from the possession of the petitioner. The petitioner is said to have fled away from the place of occurrence after the
Patna High Court Cr.Misc. No.8139 of 2015 (2) dt.02-03-2015 2/2 vehicle met with an accident.
Considering the facts aforesaid the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Kotwali P.S. Case No. 352 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
