ANJANA PRAKASH ORAL ORDER 30-01-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered under Sections 406 and 407 of the Indian Penal Code. In view of the submission of the parties that the dispute, which is financial in nature, has been settled between them, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender before the learned court below within a period of four weeks from the date of receipt of this order in connection with Maharajganj P.S. case No.113 of 2013 on furnishing bail bonds of Rs.5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan, subject to the conditions as laid down
Patna High Court Cr.Misc. No.34302 of 2013 (5) dt.30-01-2015 2/2 under Section 438(2) of the Code of Criminal Procedure as also condition that one of the bailor will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will undertake to furnish information to the Court about any change in address of the petitioner.
The Court below is directed to pass necessary orders within a period of fifteen days from the date of receipt of this order upon the application for withdrawal of the prosecution filed on behalf of the Informant in accordance with law. (Anjana Prakash, J) Narendra/- U T
