The petitioners seek regular bail in connection with Madhepura (Ghailash) P.S.Case No.77of 2017 registered for offences punishable under Sections 341, 307, 324, 379 and 34 of the Indian Penal Code and Section 27 of the Arms Act. As per F.I.R. the petitioners is said to have fired causing injury to the informant.
Submission of the learned counsel for the petitioners is that one month prior, the petitioners had filed a case against the informant and others and for that; they have been falsely implicated in this case and the same will appear from the fact that in the F.I.R. it is alleged that they have fired but it is not
Patna High Court Cr.Misc. No.30248 of 2017 (2) dt.19-07-2017 2/3 mentioned on which part the injury has been caused. Further submission is that the impugned order shows that the injuries are simple in nature. The petitioners are in custody for about three months.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Madhepura, in connection with Madhepura (Ghailash) P.S.Case No.77 of 2017. With following conditions :
(i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
(ii) The petitioners will not induce any witness or tamper with the evidence.
(iii) The petitioners shall co-operate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reason, otherwise, their bail bond shall be cancelled.
With the aforesaid observation, this application is allowed. (Vinod Kumar Sinha, J) chn/-
