The petitioners seek bail in a case instituted for the offences under Sections 147, 149, 341, 302, 323, 342, 307 of the Indian Penal Code.

The prosecution case in short is that while the deceased was returning to home, the accused persons, variously armed, assaulted him due to which he sustained injuries and later died on the way of hospital.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 5.9.2018 and have got no criminal antecedent. There is no allegation of tampering of

Patna High Court CR. MISC. No.13203 of 2019(3) dt.10-05-2019 2/2 witnesses alleged against the petitioners. Charge-sheet has been submitted in the present case. The petitioners have falsely been implicated in the present case. The main allegation is against co-accused namely Jag Narain Manjhi who is said to have assaulted upon the deceased. No assault has been made by the petitioner on the deceased.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -XIII, Gaya in connection with Atri P.S. Case No. 296/18.
