JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-03-2016 Petitioners being parents and unmarried sister of the husband of the informant are apprehending their arrest in a case registered for the offences punishable under Sections 498A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
The basic accusation is of torture for nonfulfilment of dowry demand. It is submitted by learned counsel for the petitioners that there is omnibus and general allegation against the entire in-laws family including the petitioners and it is the informant who deserted her husband. The husband of the informant has filed Matrimonial Suit No. 511 of 2015 for the restitution of conjugal life. The informatory petition was also filed on 01.09.2015 and thereafter on 07.01.2016 the present
Patna High Court Cr.Misc. No.11866 of 2016 (2) dt.10-03-2016 2/2 F.I.R was registered.
Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, West, Muzaffarpur in connection with Muzaffarpur Mahila P.S. Case No. 06 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
