The petitioner seeks bail in connection with Sessions Trial No.326 of 2016, arising out of Mushahari P.S. Case No.209 of 2015/G.R. Case No.6585 of 2015, registered under Section 364(A) of the Indian Penal Code.
The accusation is of kidnapping of Vipul Kumar, the son of the informant, by the F.I.R. named accused Mantu Das. Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner surfaced in this case in the confessional statement of the co-accused Saroj Kumar Thakur.

No.19241 of 2017 (4) dt.28-06-2017 2/2 While the statement of the victim Vipul Kumar, the son of the informant, was recorded under Section 164 of the Code of Criminal Procedure after returning to his house but he has only disclosed the name of the F.I.R. named accused Mantu Das and not any others. The petitioner having no criminal antecedent is in custody since 01.01.2016 and, after investigation, the chargesheet has already been submitted against the petitioner. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 3rd Additional Sessions Judge, Muzaffarpur, in connection with Sessions Trial No.326 of 2016, arising out of Mushahari P.S. Case No.209 of 2015.
