This is repeat application seeking bail in connection with Magadh Medical P.S. case No. 122 of 2013, registered under Sections 341, 323,452,324,307, 379 and 504/34 of the IPC. Considering the allegations and the other relevant facts, his prayer for bail was earlier considered and rejected vide order dated 25.11.2016 (Annexure-1).
Learned counsel submits that for not having submitted to the jurisdiction of the Court immediately after the registration of the case, the court has observed that the prayer for bail was rejected at that stage. It is stated that the petitioner is in custody since 05.09.2016. He has no criminal antecedents.
Patna High Court Cr.Misc. No.18420 of 2017 (3) dt.21-06-2017 2/2 Considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. Let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge VI, Gaya in connection with Magadh Medical P.S. case no. 122 of 2013 corresponding to Sessions Trial No. 16/17/232/16, subject to the following conditions:- (i) One of the bailors shall be the own/close family member of the petitioner.
(ii) No sooner the charges are framed the petitioner shall continue to appear before the court below in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance with law.
