The petitioners have filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 302, 143, 341, 323, 324, 307 of the Indian Penal Code.

Allegation against the petitioners and others is that due to previous land dispute, they assaulted the informant. It is further alleged that when family members of informant came to his rescue they were also assaulted by the petitioner and co-accused persons due

It is submitted by learned counsel for the petitioners that the petitioners are innocent and they have committed no offence. They have falsely been implicated in the present case. There is admitted land dispute between the parties. There is general and omnibus allegation against the petitioners. Moreover, the petitioners are languishing in judicial custody since 07.07.2022. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as considering the fact that petitioners are ladies and their period under custoyd, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be

Case No. 95 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Madhubani.
