JUSTICE ARUN KUMAR ORAL ORDER 12-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Mohania PS Case No. 321 of 2015 registered under Sections 414 and 412 of the IPC. The allegation is that one stolen motorcycle was recovered from the possession of Ajit Kumar Chourasia, who and others disclosed that the said motorcycle was robbed by them along with this petitioner.

Submission is that recovery is from Ajit Kumar Chourasia and not from the petitioner, except disclosure of his name in the confessional statement and having criminal antecedent of the petitioner there is no other material.

Having considered the said facts and circumstances, the petitioner, namely, Antu Singh @ D.M. is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Kaimur at Bhabua in connection with Mohania PS Case No. 321 of 2015.
