Petitioner seeks bail in Desari P.S. Case No.321 of 2018 instituted for the offence under Section(s) 302/34 Indian Penal Code and Section 27 of the Arms Act.
Counsel for the petitioner submits that informant has levelled general and omnibus allegation against the petitioner. In the written report, it is alleged that younger brother of the informant was murdered between 7-8 PM. The informant has stated that accused persons were seen running away from the place of occurrence. He disclosed the name of this petitioner and other accused persons. As such, there is no allegation of specific overt act against the petitioner. It is mentioned in para 3 of the bail petition that petitioner has clean antecedents. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, II, Vaishali at Hajipur, in connection with Desari P.S.
