JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-07-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Basantpur P.S. Case No. 190 of 2019 for offences under Section 302/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedents. The deceased died on 07.06.2019. The informant learnt that his son died of due to consumption of poison. The informant alleged that the poison was administered by Gudia Devi, Wakil Ram, Suraj Ram, Dharmendra Ram and Bablu Ram. It is further submitted that similarly circumstanced co-accused, namely, Gudia Devi has

Patna High Court CR. MISC. No.14250 of 2020(2) dt.06-07-2020 2/2 been granted anticipatory bail by a coordinate Bench of this Court vide order dated 14.11.2019 passed in Cr. Misc. No. 68603 of 2019. It has come on record that the deceased was sent to the hospital and information was also furnished by the mother-in-law of the deceased.

Considering the fact that the petitioners have no criminal antecedents; similarly circumstanced co-accused has been granted anticipatory bail by a coordinate Bench of this Court and also conduct of the petitioners that they have taken the deceased to the hospital and information was furnished by the mother-in-law of the deceased, this Court is inclined to grant bail petitioners. Let petitioners, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Basantpur P.S.
