JUSTICE ARUN KUMAR ORAL ORDER 02-04-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody since 15.10.2017, seek bail in connection with Inarawa P.S.Case No. 95 of 2017 registered under Section 376G of the Indian penal Code and 4 POCSO Act.
Allegation in brief is that while prosecutrix were going to river alone to take bath, petitioners came and raped her. It is contended that mother of the prosecutrix is a lady of questionable character and she used to call petitioner no. 1 on mobile and was asking for money otherwise to lodge a case against him. It is also submitted that case was instituted after lapse of two days and no sign of sexual assault was found on her body apart from any injury on other parts of the body, and both

Having considered the aforesaid facts and circumstances, the petitioners, namely, Krishna Yadav and Anil Chaurasia, are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions JudgeI-Cum-Special Judge, Bettiah, West Champaran in connection with Inarawa P.S. Case No. 95 of 2017.
