JUSTICE SANJAY PRIYA ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner and the State. Earlier prayer for bail of the petitioner was rejected by this court vide order dated 16-03-2017 passed in Cr. Misc. No. 8735 of 2017.

The allegation against petitioner is that 400 litres of country-made liquor has been recovered from his house. Counsel for the petitioner has submitted that he is in custody since 04-12-2016.

In such view of the matter, considering the period spent by the petitioner in custody, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Runnysaidpur

Patna High Court Cr.Misc. No.25989 of 2017 (2) dt.21-06-2017 2/2 P.S. Case No. 465 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi subject to condition that both the bailors should be close relatives of the petitioner. The petitioner will file an affidavit before the court below giving undertaking that in future, he will not indulge in such type of offence, and in the event, the petitioner indulges in such type of offence, his bail bond will liable to be cancelled.
