JUSTICE BIRENDRA KUMAR ORAL ORDER 31-01-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are in custody in connection with Special Case No.15 of 2016, arising out of Rail P.S. Case No.27 of 2016, a case under Sections 20/22 of the N.D.P.S. Act. From possession of the petitioners 11 Kgs and 9.4 Kgs respectively, Ganja was recovered. The petitioners are in custody since 21.09.2016.

Earlier this Court has refused the prayer for bail on 06.03.2017 in Cr. Misc. No.55435 of 2016 with liberty to renew the prayer if the trial is not concluded within nine months. Learned counsel for the petitioners submits that the impugned

Patna High Court Cr.Misc. No.1872 of 2018 (2) dt.31-01-2018 P2/ order would reveal that only three prosecution witnesses have been examined uptil now.

Considering the period already undergone by the petitioners as well as the fact that they are females, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
