The petitioners seek regular bail in connection with Bariyarpur P.S. Case No. 102 of 2017, registered for the offence punishable under Sections 25(1-B)A, 26 and 35 of the Arms Act.

The allegation, according to the informant, is that the place of occurrence was raided during the course of investigation being made regarding a murder case and one person, namely, Sikandar Mandal, was apprehended while he was trying to flee away and from him, one country made pistol loaded with cartridges was recovered.

No.27388 of 2018(2) dt.28-05-2018 2/2 The learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in the present case and no recovery has been made from them. It is further submitted that barring one case, the petitioners have a fair antecedent and in the said case, the petitioners are on bail. It is further submitted that the petitioners are languishing in custody since 08.11.2017. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners on regular bail.

Accordingly, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Munger in connection with Bariyarpur P.S. Case No. 102 of 2017.
