The petitioner seeks regular bail in connection with Bakhri P.S. Case No. 157 of 2018 for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 216 liters of illicit liquor from straw house of the co-accused, namely, Rajiv Rajak and upon information having been supplied by the spy to the police personnel, the name of the petitioner is said to have transpired in the present case.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case

Patna High Court CR. MISC. No.13947 of 2019(2) dt.06-03-2019 2/2 inasmuch as no recovery has been made from possession of the petitioner. It is further submitted that though the petitioner is accused in four other cases, but he is on bail in three cases. It is further submitted that the petitioner is languishing in custody since 05.09.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II cum Special Judge, Begusarai in connection with Bakhri P.S.
