2. The petitioner seeks bail in connection with Nabinagar PS Case No.319 of 2025 dated 25.10.2025, instituted for the offence punishable under Sections 137(2), 140(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The brief facts of the case is that the petitioner along with other two accused persons forcibly took away Abhimanyu Choubey, cousin of the petitioner. The reason behind the occurrence was the financial transaction with regard to purchase of JCB by the co-accused Bheem Singh which was done through the victim.

4. Learned counsel for the petitioner submits that owing to some financial transaction on account of purchase of

Patna High Court CR. MISC. No.14667 of 2026(2) dt.12-03-2026 2/2 JCB the occurrence has taken place. The petitioner has been falsely implicated in this case. It is further submitted that coaccused, Bheem Singh, had given rupees twenty four lakhs for purchase of JCB machine but the victim was not giving JCB machine for which a meeting was organized but the informant has falsely lodged the present case. Further submission is that similarly situated co-accused Bheem Singh and Yogendra Singh @ Shera have been granted bail by a co-ordinate Bench of this Court on 26.02.2026 vide Cr. Misc. No.13475 of 2026. Lastly, it is submitted that the petitioner is in custody since 26.10.2025 having clean antecedents.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-1, Aurangabad, in Nabinagar PS Case No.319 of 2025.

7. The application stands allowed.
