JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-04-2015 The petitioner being husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 304B, 328, 201, 34 of the I.P.C. Accusation is killing the niece of the informant by administering poison.

It is submitted by learned counsel for the petitioner that co-accused Ram Chandra Mahto has been acquitted vide Sessions Trial No. 515 of 2012 and considering the same co-accused Lalpari Devi has been granted anticipatory bail vide Cr. Misc. No. 45352 of 2013. Let learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks and pray for regular bail in connection with Khanpur P.S. Case No. 44 of 2011, pending in the Court of learned Chief Judicial Magistrate, Samastipur. Accordingly the application is disposed off.
