This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 366(a) of the Indian Penal Code registered in connection with Bidupur P.S.Case No. 611 of 2022.

The allegation against the petitioner is that he kidnapped the daughter of the informant.

The learned counsel for the petitioner has submitted that the age of the alleged victim has been assessed as 19 years and in her statement under Section 164 of the Cr.P.C. she has stated that she wanted to marry the petitioner. He has submitted

On the other hand, the learned counsel for the informant has opposed the prayer for bail and submitted that after recovery of the victim, again the accused persons kidnapped her and in this respect another case has been filed, to which the learned counsel for the petitioner has submitted that the petitioner is in custody for long duration and there is no probability that being in custody he shall kidnap the daughter of the informant. The petitioner is a person of clean antecedent and is in custody since 18.11.2022.

Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Shri Mukesh Kumar, learned Judicial Magistrate 1st Class, Vaishali at Hajipur in connection with Bidupur P.S.Case No. 611 of 2022, subject to the following conditions:-

1. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

2. If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below
