2. The petitioner seeks bail in Bhagwan Bazar (Saran) P.S. Case No. 459 of 2025 registered for the offence punishable under Sections-103(1)/3(5) of the B.N.S.

3. The case of the prosecution, in short, is that while the informant was at her house, her co-villager namely, Manoj Kumar told her that her son Vikki Kumar was being assaulted by the petitioner and four others. Thereafter, the informant alongwith her nephew reached at the place of occurrence where they saw that the petitioner alongwith others was assaulting her son with bricks causing injury on his head as a result of which, her son succumbed to the injuries.

4. It has been submitted on behalf of the petitioner that during course of investigation, it has come to light that there was dispute between one Ravi Prakash @ Doctor and the son of the informant on the issue of consuming liquor and the informant has lodged all the

Patna High Court CR. MISC. No.14001 of 2026(3) dt.15-04-2026 2/2 family members in the present case. It has further been submitted that the nature of allegation is general and omnibus. Learned counsel for the petitioner has also submitted that similarly situated co-accused, namely, Mantu Rai has been granted bail by a coordinate bench of this court vide order dated 28-01-2026 passed in Cr. Misc. No. 4040 of 2026 and the case of the petitioner stands on similar footing. It has also been submitted that the petitioner is under custody since 04-092025 having clean antecedent.

5. Learned counsel for the informant as well as learned APP has vehemently opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IInd, Chapra in connection with Bhagwan Bazar (Saran) P.S. Case No. 459 of 2025 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
