JUSTICE BIRENDRA KUMAR ORAL ORDER 04-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 363/365/364A of the Indian Penal Code.

The F.I.R. was lodged with allegation that some unknown person have abducted to the son of the informant. The victim boy in his statement under Section 164 Cr.P.C. supported that he was abducted by two unknown person when he was along with Bimal. The unknown person served them milk with some intoxicating item, which made the victim unconscious. After regaining the consciousness, he found that police was there and he was recovered from the house of one Mahesh Singh. In the last

Patna High Court Cr.Misc. No.28269 of 2017 (2) dt.04-07-2017 2/2 line of his statement, he has stated that he heard the name of the petitioner called by another accused.

Submission of the petitioner is that he has got no criminal antecedent and has falsely been implicated in this case. Learned Additional Public Prosecutor submitted that there is no other material against the petitioner in the casediary. Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Dalsingsarai/Successor Court, in connection with Dalsingsarai P.S. Case No.210 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
