JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-07-2023 In compliance of order dated 25.05.2023, the investigating officer of this case is present with up-to-date copy of case diary. His personal appearance is dispensed with. The petitioner apprehends his arrest in a case registered for the offence under Sections 395, 427 of the Indian Penal Code.

It is submitted on behalf of petitioner that petitioner has been made accused in this case only on the basis of confessional statement of co-accused Rocky Kumar. No stolen article has been recovered from the conscious possession of this petitioner. Petitioner has got clean antecedent. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Case No. 398 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
