The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 323, 353, 307, 272, 273 of the Indian Penal Code as well as 30(a)(d) of Bihar Prohibition and Excise Act, 2016 and 25(1-b)A/26/35/27 of the Arms Act. Allegation is that 3.060 liters wine and arms are recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.11.2018. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner was not apprehended on the spot. Patna High Court CR. MISC. No.13680 of 2019(4) dt.22-04-2019 2/2 been disclosed by other co-accused. Other co-accused have been granted bail vide Annexure 2 to the present application. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge IInd-cum-Special Judge, Excise Act, Madhubani in connection with Phulparas P.S. case No.131 of 2018.
