JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-04-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Sabour P.S. Case no. 107 of 2015 registered under Sections 341, 323, 307, 379, 386, 504 and 506/34 of the Indian Penal Code. The accusation is that one boy entered into the shop of the informant raising alarm to save his life. At that time Md. Jakir, Md. Sakib @ Pardum @ Md. Shakir along with Md. Jahangir rushed there and pulled that boy causing assault to him by fist and slaps. At that time, petitioner nos. 3 and 4 also rushed there and caused assault to him.
Learned counsel for the petitioner submits that due to hot talk exchanged at the place of occurrence in which informant sustained
Patna High Court Cr.Misc. No.9868 of 2016 (2) dt.22-04-2016 2/2 injury and petitioners were also sustained injury. Three injuries found on the person of the informant Kailash Kumar is simple in nature caused by hard and blunt substance. Moreover, the informant has filed compromise petition in the court below. The petitioner having no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M.-X, Bhagalpur in connection with Sabour P.S. Case No. 107 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
