JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 147,323,324,307,379 and 504 of the Indian Penal Code. It is alleged that the mother of the informant was assaulted by co accused Santosh Kuwar alias Mukesh Kuwar when the informant and his brother went to rescue then they were also assaulted by the accused persons. It is alleged against the petitioner that he resorted to fire in air in order to create terror. It is submitted by the learned counsel for the petitioner that no fire arm injury was found to any injured though with regard to some of the injuries of the informant and brother of the
Patna High Court Cr.Misc. No.15989 of 2015 (3) dt.06-05-2015 2/2 informant opinion has been kept reserved. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Supaul P.S. Case No. 439 of 2014 pending in the court of learned CJM, Supaul.
This application is disposed of with the aforesaid observation/direction.
