JUSTICE BIRENDRA KUMAR ORAL ORDER 21-03-2018 Heard learned counsel for the petitioners, informant and learned Additional Public Prosecutor for the State. The petitioners are in custody in connection with Uchkagaon P.S. Case No.227 of 2017, a case under Sections 147/149/447/341/323/385/324/307/379/504/506 of the Indian Penal Code. Later on offence under Section 302 of the Indian Penal Code was added.

The specific allegation of commission of assault at the head of injured Vijay Shankar Tiwari is against petitioner Ravindra Tiwari. The injury was found simple by the doctor. There is no specific allegation against petitioner Hare Ram Tiwari. General and omnibus allegation is there of commission of assault

Patna High Court Cr.Misc. No.15993 of 2018 (2) dt.21-03-2018 P2/ on different family members. There is case and counter case. Learned counsel for the informant opposed the prayer for bail on the ground that all had caused injury, to the deceased, including the petitioners.

Considering the general and omnibus nature of allegation, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Uchkagaon Police Station Case No. 227 of 2017, with condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
