Petitioner is seeking bail in a case registered under Sections 272, 273 of Indian Penal Code and Section 38 of the Bihar Excise Act.

Petitioner submits that there is nothing on record to show that the petitioner deals in the business of liquor other than his own statement which is attributed to him in the first information report. He denies the said statement. He further submits that there is lacuna in the alleged seizure of the articles. He is in custody since 26.11.2016 and he has stated that he has no criminal antecedent.

Considering the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.28499 of 2017 (2) dt.01-07-2017 2/2 the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Araria in Jogbani Police Station Case No 163 of 2016.
