Petitioner seeks bail in connection with Kishanpur P.S. Case No. 09 of 2018 for offences punishable under Sections 366-A/34 of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that her daughter Saro Kumari, aged 14 years and daughter of her brother-in-law(Bhainsur), aged 17 years, were abducted by the petitioner and other accused persons.

It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and the two girls have been recovered, who have stated in their statement under Section 164 Cr.P.C. that they had gone to their aunt's house and stayed there for 3-4 days. He submits that no allegation has been made against the petitioner

Patna High Court Cr.Misc. No.22321 of 2018(2) dt.19-04-2018 2/2 in the statement under Section 164 Cr.P.C., even his name has not been whispered and petitioner being the neighbour of the informant has been falsely implicated in the aforesaid case. However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Kishanpur P.S. Case No. 09 of 2018.
